Cases Involving Injuries to Children:

Jeff Peraldo represented a teenager whose vehicle had been struck and run off of the road by a hit and run driver. The client's' vehicle went out of control and rolled several times. The client sustained injuries to his lower extremities. The client's own insurance company refused to provide insurance coverage for the client's injuries and litigation against the insurance company was necessary. After an exhaustive arbitration hearing with full testimony and medical evidence, an arbitration panel awarded the client damages in the amount of $117,000.

Jeff Peraldo represented a young boy, a visitor to his grandfather's farm, who had been struck by a vehicle being operated by a contractor's employee on farm property. The child sustained severe leg injuries. Liability was denied by the responsible insurance company based on a claim that the child had "darted" into the path of the workers' vehicle, thus making litigation and extensive discovery necessary. The firm's case investigation identified several witnesses who testified that the child had not run into the path of the defendant's vehicle as the defendant had claimed and the case was settled at mediation for $280,000.

Jeff Peraldo represented a young girl who sustained facial lacerations when the vehicle in which she was riding as a passenger was struck at an intersection by another vehicle that had run a red light. The at-fault driver initially denied responsibility for the collision and litigation was necessary. The case eventually settled at mediation for $156,000.

Jeff Peraldo represented a young girl who sustained leg injuries when her vehicle was struck by a vehicle that had turned in front of them at an intersection. The girl sustained a laceration and scarring to her knee. Her case settled without litigation for $42,500.

Jeff Peraldo represented a teenage girl who was injured when the vehicle in which she was riding as a passenger left the roadway and struck a streetlight pole. The girl sustained severe facial bruising and a laceration above her eye. The insurance company for the at fault driver paid the child's medical expenses, but refused to make reasonable compensation for the child's injuries, making litigation necessary. The jury returned a verdict in the amount of $25,000 for the child.

Jeff Peraldo represented a small child who was injured when he was struck by a car in the street in front of his house. The defendant driver claimed she had been driving slowly down the street when the child darted in front of her vehicle. The extensive case investigation identified a neighbor who had witnessed the accident and who testified that the driver appeared to be lost and was looking at house numbers when her vehicle drifted to the right and struck the child. The case then settled without litigation for a confidential amount.

Jeff Peraldo represented two teenagers who were shot and severely injured during an attack on an arcade/gameroom located in a strip shopping center. The case investigation showed the shopping center and gameroom had been the location of numerous crimes of violence prior to the injuries to the clients. The owner of the shopping center and the owner of the gameroom both denied liability and litigation was necessary. A retained shopping center security expert determined the shopping center was negligent in its maintenance of its property at the time the clients were attacked by not having functioning parking lot lighting and periodic security guard patrols. The expert determined the owner of the gameroom was negligent in not taking steps to curtail and control the acts of violence then occurring in the game room. The court entered judgment against the owner of the gameroom for an amount in excess of $2 million. The cases against the owner of the shopping center later settled for a confidential amount.

Jeff Peraldo represented a young boy who sustained eye and facial injuries when he was shot in the face with a pelletgun by a playmate. The case investigated showed that the client and his friend had been out target shooting with the gun when, for no apparent reason, the playmate turned and fired the gun in the client's direction. The insurance company denied the child's claim and alleged the client had been negligent by walking into the area in which the gun was being fired. The case investigation identified another child who had been at the scene and who fully corroborated the client's version of the injury incident. The later settled without litigation for a confidential amount.

Kara Edmunds represented a young girl who fell from a horizontal ladder on the playground of her private school. The girl sustained a broken arm that required two surgical procedures to repair. The school denied liability even though the parents and teachers had repeatedly complained that the playground was overcrowded, under-supervised, and lacked the appropriate groundcover. Investigation also revealed that the horizontal ladder was installed too high. The case settled without litigation for nearly $35,000.
