Products Liability Cases:
Products liability cases involve claims arising from injuries caused by defective products. Defects can be either a defect in the manufacturing process or a design defect. These cases are proven by one or two methods or both. First, an injured party may be able to prove, usually through an expert witness, that a specific negligent act resulted in either a manufacturing defect or a defective design of the product. Second, unless expressly disclaimed by an express warranty, all products are sold with an implied warranty that the product is fit and safe for its intended purpose. A breach of this implied warrant can be shown by a failure of the product to work safely and properly when being used as intended.
The following are examples of product liability cases the firm has handled:
Jeff Peraldo represented a man who was severely injured when the seat of his rental "bobcat" mini-bulldozer flipped and threw him as he was driving the machine down a slight incline. The case investigation showed the seat in the bulldozer had been negligently installed. The case settled without litigation.
Jeff Peraldo represented a man who was thrown from his high performance racing bicycle when the front tire came apart. Litigation was necessary with both the manufacturer of the tire and the company that had installed the tire. The case settled shortly before trial.
Jeff Peraldo is currently representing two clients who sustained injuries when the airbags in their cars failed to deploy in high speed impact collisions. Nonetheless, the automobile manufacturers have denied liability for the product failures. The firm has consulted with premier airbag and automobile crashworthiness experts and the cases will soon be in litigation.
