Nursing Home Negligence Cases:
We trust nursing homes, assisted living facilities and independent living facilities to take care of our senior citizens when they cannot take care of themselves. Sometimes, mistakes are made and family members suffer. Like medical negligence cases, the law requires that nursing homes and their staffs fulfill the professional standards of care of the community in which they provide nursing home services. A breach of the standard of care, which in most cases must be established by competent expert testimony, is negligence.
The following are examples of nursing home negligence cases the firm has handled:
Jeff Peraldo represented an elderly woman who sustained a hip fracture after being struck in her independent living facility by a fellow resident operating a motorized scooter. The case investigation showed the fellow resident had, prior to the date of the client's injury, struck two other residents and these prior incidents had been reported to the facility. Despite these prior incidents, the facility continued to allow the resident to use her scooter. The case investigation further showed the resident did not have the capacity to properly and safely operate her scooter and was a threat to the safety of other residents. The facility denied liability and litigation was necessary. The cases against the fellow resident and the facility eventually settled for the total amount of $127,000.
In a companion case, Jeff Peraldo represented an elderly woman who was the first resident struck by the fellow resident operating a motorized scooter. The woman sustained a fractured vertebra in her lower back. The case against the resident was settled without litigation for the amount of $75,000.
